Placement in Boarding Homes by the Government of Canada

This class action seeks to compensate individuals placed with a family by the government of Canada, for the purpose of attending elementary or secondary school (whether in an Aboriginal or urban community), as well as their family members, for the psychological, physical and sexual abuse committed there.

This action does not include placements for the purpose of attending a post-secondary institution, or placements within the child protection system.

We represent the Quebec Subclass, i.e., members who resided in Quebec at the time of their placement in a boarding home. Klein Lawyers represent the national group, i.e., members who resided outside of Quebec at the time of their placement.

On December 11, 2023, the Federal Court approved by order the Settlement Agreement presented  in September 2023. However, reasons are to follow and will be provided by Justice Pamel at a later date. We will publish the decision on our website when it is available.

A settlement agreement was reached on June 15, 2023. The settlement agreement includes $10,000 in compensation for those who were placed in boarding homes between September 1, 1951, and June 30, 1992, and additional compensation of up to $200,000 in cases of physical and sexual abuse.

Although the Settlement Agreement has been approved by the Court, the claims process is not yet open, and the implementation date has not been set. We will provide information on the claims process as soon as the forms are available.

You might be a member of this class action if you fit into one of these two categories:

You were placed with a family by the government of Canada, for the purpose of attending elementary or secondary school (whether in an Aboriginal or urban location) in a Canadian province or territory;

Or

You are a family member of a person who was placed by the Government of Canada with a family for the purpose of attending elementary or secondary school (whether in an Aboriginal or urban community), and you have your own claim based on your family relationship with this person and damages were suffered from this person’s placement.
